Michigan tailback Fitz Toussaint is listed No. 1 on the depth chart released Monday, though coach Brady Hoke told reporters he has not made a decision about Toussaint's status with the team.
Toussaint was suspended after his July 21 drunken-driving arrest but has been practicing since the second week of fall camp.
The other player facing legal problems, defensive end Frank Clark, is listed as a second-string defensive end. Hoke said he has not made a decision about Clark's statue, either.
Hoke said the two players were "not done paying consequences."
Michigan plays Alabama on Saturday to open the season.
